Abstract

Discusses the implications of the Supreme Court decision in R. (on the application of JS) v Secretary of State for Work and Pensions, and the Administrative Court ruling in R. (on the application of Hardy) v Sandwell MBC for successful challenges to the benefit cap, and councils' discretionary housing payment policies. Reviews key features of both judgements, including the significance of the ECHR, and considers their effect on welfare reform.
