Comments on the Divisional Court decision in R. (on the application of Wheeler) v Office of the Prime Minister on whether the claimant had a legitimate expectation that the Treaty of Lisbon 2007 would not be ratified without a referendum. Considers the Court's application of the constitutional principle of separation of powers.
