Abstract

Appraises the Chancellor of the Exchequer's proposals to introduce measures to encourage whistleblowing within financial institutions and markets following the suspected market manipulation of the price of HBOS shares in March 2008. Outlines the remit of the Financial Services Authority and its existing powers of criminal prosecution. Looks at the definition of market abuse and how it is currently dealt with by statute. Explains the background to the HBOS affair. Identifies a number of concerns about encouraging whistleblowing, arising from past examples and from City culture.
