Dr. Emma Jane Louise Waring

Senior Lecturer

Research interests

My research focus is on the public/private interface in property law, particularly in relation to expropriation of property rights and constitutional property protection. I also work on issues relating to land registration and decision-making, as well as art law and the interplay of property rules with ethical and commercial considerations.

I welcome applications for research students interested in land law, property law and theory, constitutional property, art law and land registration. My current research projects include a monograph exploring private-to-private expropriation of property rights in Anglo-American law, and work on a land law treatise.

Employment History

I am a Lecturer at York Law School, teaching and researching in the areas of Property Law and Theory, Land Law and Art Law. I am Module Leader for the Property 1 course at York Law School which focuses on land law, and also established and now co-teach a third-year module in Art Law with Professor Michael White from the History of Art Department at the University of York. Previously, I was a Fellow and Newton Trust Lecturer at St John's College, the University of Cambridge where I supervised Land Law, Criminal Law, and Constitutional Law.

I studied for my undergraduate degree in Law at Newnham College, the University of Cambridge before undertaking the Legal Practice Course at Nottingham Trent Law School. After this, I studied for an LLM at Harvard Law School and qualified as a New York Attorney. I trained and qualified as a Solicitor with Allen & Overy in London before becoming a Judicial Assistant to Lord Steyn, Lord Walker and Lord Carswell at the House of Lords. Following this, I returned to Newnham College for my doctoral studies and my PhD was supervised by Professor Kevin Gray. I joined St John's College, the University of Cambridge as a Fellow and was awarded a Newton Trust Lectureship by the Faculty of Law. In 2013 I joined York Law School as a Lecturer.
